Terms and Conditions

The following memberships (USATF, KoJo Sports, and UTPVA) must be taken care of before the participant may register as an athlete with Utah Pole Vault Academy.

USATF

All athletes participating in club activities must have a valid current USA Track & Field membership to participate with Utah Pole Vault Academy activities and events. If you do not have a current USATF membership, please visit the USATF website to Join or Renew your membership before continuing. Visit https://www.usatf.org/membership/application/index.asp in order to join or renew.

For USATF Membership, register as: Utah Pole Vault Academy #34-0203 zip code 84065. If you are not associated with the Utah Pole Vault Academy club, email membership@utah.usatf.org to have it changed.

 

Membership with USATF is for the club insurance to cover each athlete. If an invalid number is entered to complete the form, the athlete will not be able to participate in any Utah Pole Vault Academy practices, activities or events until a valid USATF membership can be confirmed. 
 

All athletes must be able to confirm that they have read and understand the USATF Release and Liability agreement presented below. If the athlete is under 18 years of age their guardian must also confirm to have read, understand and agree to the USATF Release and Liability agreement below.

KoJo Sports Training Complex
All athletes participating in UTPVA club activities must have an annual KoJo Sports Facility membership. This includes a $35 annual fee allowing the athlete to participate in training at the KoJo Sports Training Complex for one year. All athletes must be able to confirm that they have read and understand the KoJo Sports Release and Liability agreement presented below. If an athlete is under 18 years of age their guardian must also confirm to have read, understand and agree to the KoJo Sports Release and Liability agreement below.

Utah Pole Vault Academy

An online registration must be completed for all athletes wishing to participate in and Utah Pole Vault Academy club activities. The registration form includes a release and liability agreement which must be filled out for each athlete and agreed upon by all adult participants and/or each youth participant's legal guardian in order to participate in any Utah Pole Vault Academy club activities or use Utah Pole Vault Academy poles and other equipment.

After registering as a new athlete by filling out the form and accepting the terms and conditions, athletes will be able to obtain memberships and reserve spots for practices. A separate account will need to be created for each participant by completing the registration form accepting the terms and conditions.

All liability and release forms must be read, understood, and agreed to in full for each individual participant before participation in any UTPVA club activities will be permitted. All fees must be paid in full in order to participate. This includes, but is not limited to: KoJo Sports facility use annual fee, Practice fee, Membership fee, Camp fee, Clinic fee, or Private session fee. 

Release & Liability Agreement

Kojo Sports Training Facility Release & Disclaimer:

I do hereby assume full responsibility for any and all damages, injuries (including death), or losses that I may sustain or incur, if any, while attending, engaging, practicing, participating or witnessing activity and/or certain event(s) occurring in or about the premises or at any offsite location. I hereby assume full risk, waive all claims and release and hold KoJo Sports, LLC, individually or otherwise, harmless for any and all liability, claims, suits, damages, expenses, fees, actions, or rights of action or judgments as a result of injury or death to myself or members of my family or heirs, or my guests, or damage, destruction or loss to my property, which in any way relates to, arises out of, or is in any way connected with my presence on the premises, or my participation in events of activities thereon, or the negligent acts or omissions of the releases or any other third party.

I agree to wear all protective equipment required while participating in the activity, and I am fully aware and understand that KoJo Sports, LLC does not have on or about the premises, or employ or contract with any medical services, provisions for ordinary or emergency medical services.

In consideration of my participation in and the use of the KoJo Sports, LLC premises or facilities, I hereby release and covenant not to sue the owner of the premises (releases), shareholders, directors, officers, employees, representatives, agents, affiliates and lessees from any and all claims resulting from any physical injury that may occur to me while participating in any program or event sponsored by KoJo Sports, LLC.

I HAVE READ AND FULLY UNDERSTAND THE ABOVE RELEASE/WAIVER AND FULLY UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO THIS WAIVER VOLUNTARILY.
Parents or guardians must sign if applicant is UNDER 18.

Utah Pole Vault Academy Liability:

In consideration of the participating in club/camp/clinic/competitions with the Utah Pole Vault Academy at the Kojo Sports facility located at 12472 S Meadow Spring Ln, Riverton, Utah 84065, I hereby agree to the following:

To the best of my knowledge, I am in good physical condition and fully able to participate in pole vaulting. I am fully aware of the risks and hazards associated with the participation in this event, including physical injury or even death, and hereby elect to participate in said event, knowing that the associated physical activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this course.

I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, Utah Pole Vault Academy (Kojo Sports, LLC), members, agents, employees, and USA Track & Field (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in physical activity, while using any equipment (poles, pits, etc.), or while on or upon the premises where the event is being conducted.

It is my expressed intent that this release and hold harmless agreement shall bind the members of my family guardians and spouse, if I am alive, and my guardians, heirs, assigns, and personal representatives, if I am deceased, and shall be deemed as a RELEASE, WAIVE, DISCHARGE, and CONVENTION TO SUE the above named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be constructed in accordance with the laws of the State of Utah.

In agreeing to signing this release, I acknowledge and represent that I HAVE READ THE FORGOING Waiver of Liability and Hold Harmless Agreement, UNDERSTAND IT AND SIGN IT VOLUNTARILY as my own free act and deed; no oral representations, statements or inducements, apart from the forgoing written agreements have been made; and I EXECUTE THIS RELEASE FOR FULL ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY SAME.


Utah Pole Vault Academy frequently takes pictures and videos of athletes in order to analyze the specific needs of athletes, celebrate their successes, and promote the sport and the club. As such, UTPVA seeks your consent to release. If consent is given, you will consent to the following statement.

PHOTOGRAPHIC CONSENT RELEASE
I (the “individual”), the parent or legal guardian of, grant to the Utah Pole Vault Academy (“UTPVA”) and those acting under its supervision/permission or upon its authority, the irrevocable and unrestricted right to use and publish any photographs, videos, reproductions, images or likenesses, including, without limitation, all derivative works thereof (“PHOTOGRAPHIC MATERIAL”) of the individual taken for the use in publications or social media referencing or related to the UTPVA, the furtherance of the sport of pole vaulting, or the achievement of the athletes of the UTPVA. In addition, the individual grants permission to reference the athlete’s name and/or achievement represented in the PHOTOGRAPHIC MATERIAL, and to alter the PHOTOGRAPHIC MATERIAL without restriction; and to copyright the PHOTOGRAPHIC MATERIAL. This authorization and release covers the use of the PHOTOGRAPHIC MATERIAL in any published and/or electronic form and medium of advertising or publicity for an unlimited period of time. This consent and release form represents in full all the terms and considerations, and no other inducements, statements or promises have been made to the individual, nor have I been offered or accepted any remuneration for my voluntary participation.

USATF Participation Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement

For and in consideration of USA Track & Field, Inc. (“USA Track & Field” or “USATF”) allowing me, the registrant, to participate in the USA Track & Field sanctioned event I am registering for herein (the “Event” or “Events”); I, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”);

1.    I hereby represent that (i) I am at least eighteen (18) years of age (or this Agreement is also agreed to by my parent, natural guardian, or legal guardian (the “Guardian”)); (ii) I am in good health and in proper physical condition to participate in the Event; and (iii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in the Event.  I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event, that I am responsible for my own safety and well-being at all times and under all circumstances while at the Event site.
2.    I understand and acknowledge that participation in track & field, road running, race walking, cross country, mountain, ultra, and trail running Events is inherently dangerous and represents an extreme test of a person’s physical and mental limits. I understand and acknowledge the risks and dangers associated with participation in the Event and sports of track & field and related activities, including without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life; loss of or damage to equipment/property; exposure to extreme conditions and circumstances; contact with other participants, spectators, animals or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or track conditions; land, water and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event Organizers (as defined in Section 4 below); and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions or the actions or inactions of others participating in or organizing the Event, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in any Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties (as defined in Section 4 below).
3.    I agree to be familiar with and to abide by the Rules and Regulations established for the Event, including but not limited to the Competition Rules adopted by USA Track & Field and any safety regulations established for the benefit of all participants. I accept sole responsibility for my own conduct and actions while participating in the Event, and the condition and adequacy of my equipment.
4.    I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties, as relevant and applicable in each instance: USATF, its members, clubs, associations, sport disciplines and divisions; United States Olympic Committee (USOC); the event directors, the host organization and the facility, venue and property owners or operators upon which the Event takes place; and any other organizers, promoters, sponsors, advertisers, coaches and officials for this Event; law enforcement agencies and other public entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and attorneys’ fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties, as relevant and applicable in each instance.
5.    As a condition of my participation in the Event, I hereby grant USA Track & Field, the event director and host organization a limited license to use my name, likeness, image, photograph, voice, video, athletic performance, biographical and other information (collectively, “Likeness”), in any media platform or format whatsoever, and to distribute, broadcast and exhibit these without charge, restriction or liability, but only for the purposes of advertising or promoting the Event, USATF, or the sport of Athletics.  The foregoing grant, however, does not constitute consent for USATF or any third party to use my Likeness in an endorsement of any product or service without my specific written consent.

I hereby warrant that I (or the Guardian, if I am under the age of 18) am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by accepting it (including the rights of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have accepted this Agreement without any inducement, assurance or guarantee, and intend for my acceptance to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

If the participant is under the age of 18, the Guardian hereby agrees to release and discharge the Released Parties as follows:  a) The Guardian acknowledges and understands that the Event is inherently dangerous and represents an extreme test of a person’s physical and mental limits.  Further, the Guardian acknowledges and understands the Risks, as defined above.  b) The Guardian acknowledges the rights waived by both the Guardian and the participant by accepting this Agreement. c) The Guardian acknowledges that the Guardian will indemnify the Released Parties from any and all Liability which may arise out of, result from, or relate in any way to the participant’s participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties.
